CONSENT CALENDAR - All matters listed under the Consent Calendar are considered to be routine and will be enacted by one motion without discussion. Persons wishing to speak regarding Consent Calendar matters should file a “Request to Speak” form with the City Clerk. (Agenda Items 1-16)
1. WAIVE READING IN FULL OF ALL ORDINANCES AND RESOLUTIONS ON THE AGENDA
2. APPROVAL OF MINUTES - THE SPECIAL MEETING AND THE REGULAR MEETING OF THE CITY COUNCIL HELD ON JUNE 3, 2025.
3. RATIFICATION OF PAYROLL AND DEMANDS The City Council has approved the use of Government Code Section 37208 to expedite the payment of City of Tustin obligations that are in accordance with the approved budget or continued operations authorizations.
4. SECOND READING AND ADOPTION OF ORDINANCE NO. 1566 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING DEVELOPMENT AGREEMENT 2024-0004 - COMPASS AT RED HILL BY MERITAGE HOMES, INC. - A 73 UNIT CONDOMINIUM PROJECT Adoption of Ordinance No. 1566 approves Development Agreement 2024-0004 for a residential development project that would include 73 condominium units, four of which will be set aside as affordable units on approximately 3.4 acres site located at 13751 and 13841 Red Hill Avenue.
5. SECOND READING AND ADOPTION OF ORDINANCE NO. 1568 - DESIGNATING THE STATE FIRE MARSHAL'S 2025 LOCAL RESPONSIBILITY AREA FIRE HAZARD SEVERITY ZONES AS REQUIRED BY CALIFORNIA LAW Adoption of Ordinance No. 1568 designates the State Fire Marshal's 2025 local responsibility area fire hazard severity zones as required by California law.
6. BUILDING BOARD OF APPEALS APPOINTMENTS City Council approval is required for the Mayor's appointment of two Building Board of Appeals members.
7. ADOPT RESOLUTION NO. 25-46 APPROVING FISCAL YEAR 2025-2026 SENATE BILL 1 PROJECT LIST TO BE SUBMITTED TO THE CALIFORNIA TRANSPORTATION COMMISSION To be eligible to receive new funding under Senate Bill 1, the City is required to submit a Project List to the California Transportation Commission no later than July 1, 2025.
8. SET PUBLIC HEARING FOR WATER QUALITY REPORT ON PUBLIC HEALTH GOALS 2022-2024 The California Health and Safety Code requires that water systems with more than 10,000 service connections prepare a report every three years and conduct a public hearing to provide information to consumers on levels of contaminants in the City's drinking water.
9. ACCEPT IMPROVEMENTS AND FILE A NOTICE OF COMPLETION FOR THE BENETA WELL NO. 2 - PHASE II EQUIPPING PROJECT Construction of the Beneta Well No. 2 - Phase II Equipping Project has been completed to the satisfaction of the City Engineer and is now ready for City Council acceptance.
10. AWARD CONSTRUCTION CONTRACT FOR THE EL CAMINO REAL WATER MAIN RELOCATION PROJECT Staff is requesting the City Council award a construction contract to the lowest responsive/responsible bidder for the El Camino Real Water Main Relocation Project.
11. APPROVE AMENDMENT TO ATTACHMENT AGREEMENT WITH THE SOUTHERN CALIFORNIA GAS COMPANY The Southern California Gas Company has been deploying advanced metering technology throughout their service area. On February 7, 2023, the City Council approved an Attachment Agreement which allowed installation of one metering device on a City-owned street light pole. The Southern California Gas Company is requesting four additional locations be included in the agreement.
12. APPROVE THE ANNUAL OC GO (MEASURE M2) ELIGIBILITY SUBMITTAL PACKAGE, FISCAL YEAR 2025-2026 To maintain eligibility to receive OC Go (also known as Orange County Measure M2 Program) funding, the City is required to annually submit a compliance package to the Orange County Transportation Authority.
13. RESOLUTION DETERMINING THE NEED TO CONTINUE THE PROCLAIMED LOCAL EMERGENCY RELATED TO THE NAVY NORTH HANGAR At its meeting on November 10, 2023, the City Council ratified the Acting City Manager's Proclamation of Local Emergency related to the fire at the Navy's North Hangar and release of chemicals of public health concern, including asbestos. At a special meeting of the City Council on January 9, 2024, and at its regular meetings on March 5, 2024, April 16. 2024, June 4, 2024, June 18, 2024, July 16, 2024, August 20, 2024, October 15, 2024, December 3, 2024, January 21, 2025, March 18, 2025, and May 6, 2025, the City Council reviewed and determined the need to continue the local emergency. This item recommends that the City Council once again review and determine that the need exists to continue the local emergency, as required by State law.
14. COMMUNITY FACILITIES DISTRICT 2018-01 ZONE 3 Request for approval of the implementing documents and resolution related to the annexation of property subject to a Disposition and Development Agreement between the City and Tustin Legacy Acquisition LLC (Irvine Company) into Community Facilities District 2018-01 and designating the property as Zone 3.
