6. QUARTERLY INVESTMENT REPORT FOR THE CITY OF TUSTIN AND THE SUCCESSOR AGENCY FOR THE TUSTIN COMMUNITY REDEVELOPMENT AGENCY FOR THE QUARTER ENDING SEPTEMBER 30, 2022 Government Code Section 53646 requires that the Treasurer make an Investment Report to the City Council at least quarterly showing balances by authorized investment and certifying its compliance with the adopted Investment Policy.

7. MEASURE M2 FAIRSHARE ANNUAL EXPENDITURE REPORT The Local Transportation Authority Ordinance No. 3 requires the City to adopt an annual Expenditure Report to account for the Net Revenues, developer/traffic impact fees, and funds expended by the City, which satisfy the Maintenance of Effort (MOE). The Orange County Transportation Authority (OCTA) established the MOE benchmark in conjunction with passage of the original Measure M. MOE is a requirement that the City expend local funds on transportation related projects each fiscal year in order to be eligible to receive Measure M2 Fairshare funds; the City’s required MOE expenditure for Fiscal Year 2021-22 is $1,697,045. This figure will remain the same through Fiscal Year 2022-23.

ADOPT RESOLUTION NO. 22-55 TO ACCEPT IMPROVEMENTS FOR THE FISCAL YEAR 2021-2022 ROADWAY REHABILITATION AND SIDEWALK REPAIR PROJECT, ZONE 3, CIP NO. 70021 AND AUTHORIZE THE CITY ENGINEER TO FILE A NOTICE OF COMPLETION Construction of the Fiscal Year 2021-2022 Roadway Rehabilitation and Sidewalk Repair Project, Zone 3 (CIP No. 70021), has been completed to the satisfaction of the City Engineer and is now ready for City Council acceptance.

HISTORIC PROPERTY PRESERVATION AGREEMENT (MILLS ACT) FOR THE PROPERTY AT 158 N B STREET The Mills Act is a State program that provides property tax relief to owners of qualified historic properties who agree to comply with preservation restrictions and maintain and preserve the property for a minimum of ten (10) years. The City Council adopted Resolution 97-50, authorizing the implementation of the Mills Act program and established a policy specifying which properties would be eligible for the program. While the Mills Act is a State program, property owners enter into a contract with the City to obtain the program's benefits. Attachment A contains the Historic Property Preservation Agreement for the subject property located at 158 N B Street.

POLICY REGARDING THE REPORTING OF SUSPECTED FRAUD The Government Finance Officers Association (GFOA) recommends that every government establish policies and procedures to encourage and facilitate the reporting of suspected fraud, waste or abuse. In order to demonstrate the City’s commitment to fiscal stewardship and accountability, a policy has been prepared for City Council consideration, which memorializes informal procedures currently in place governing the reporting of suspected fraud, waste or abuse.

18. TEMPORARY COMMUNITY GARDEN AT 450 EL CAMINO REAL Consideration of a request from One Seed to operate a temporary community garden on City property located at 450 El Camino Real. One Seed is proposing to temporarily use the empty lot on the west side of the existing wooden fence of the El Camino Real Respite Parkette into a community garden that would grow fruits and vegetables. Their objective is to create a space that would serve as an outdoor classroom, providing community members with a variety of adult and youth educational workshops and gardening programs. All designed with the intent and ability to be relocated to a permanent location in the future.
