10. ORDINANCE NO. 1529 AMENDING CHAPTER 1 OF ARTICLE 8 OF THE TUSTIN CITY CODE AND ADOPTING THE 2022 CALIFORNIA BUILDING STANDARDS CODE, RELATED MODEL CODES WITH CERTAIN APPENDICES, AND SUPPLEMENTAL REGULATIONS, AND ADOPTING AMENDMENTS THERETO
Every three (3) years, the State of California Building Standards Commission selects and adopts new construction regulations substantially based on internationally published model codes. Collectively, these State regulations are known as the California Code of Regulations (CCR), Title 24, or most commonly, the "California Building Standards Code." State law requires the 2022 California Building Standards Code to apply to all California cities effective January 1, 2023.
The State of California's Health and Safety Code Section 17958.7 and 18941.5 also permits local governments to adopt amendments to the California Building Standards Code when they are administrative or procedural, or when there are local climatic, geological or topographical conditions that exist within their communities. The local government amendments however, may not be less restrictive building standard than that contained in Title 24. Health and Safety Code Section 18941.5.
To comply with the State Law, Ordinance No. 1529 is proposed to adopt and amend the 2022 Building Standards Code with certain Appendices and supplemental regulations. Resolution No. 22-43 is the accompanying resolution that provides express findings that such changes or modifications are reasonably necessary due to local climatic, geological or topographical conditions for the City of Tustin.
